It is submitted on behalf of the petitioner that an application submitted by the predecessor-in-interest of the petitioner under Section 8 of the West Bengal Land (Requisition & Acquisition) Act, 1948 read with Section 18 of the Land Acquisition Act, 1894 was disposed of by the learned Land Acquisition Judge by an order passed on 12th June, 2001 in LA Case no.39 of 1997, allowing the reference on contest. The State carried the said order in appeal which was dismissed for default and subsequently restored. The appeal is still pending before this Court. Learned counsel for the petitioner submits that the petitioner is ready and willing to accept the amount the State decides to pay as compensation and settle the issue with the State amicably out of Court.

Learned counsel for the petitioner seeks to take necessary steps before the appropriate Bench dealing with the appeal.

In view of the above, the writ petition is disposed of. Liberty is granted to the petitioner to take appropriate steps before the learned Bench dealing with the appeal. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
