Learned advocate appearing for the petitioner submits that although there was recovery of 7000 bottles of phensedyl but the petitioner has been implicated on the basis of statement of co-accused. It has also been submitted that the owner of the vehicle who is principally responsible in connection with the instant case has been released on bail. Learned advocate for the State opposes the prayer for bail but is unable to dislodge the arguments that petitioner has been implicated solely on basis of statement of the co-accused. Learned advocate also submitted that petitioner has similar antecedents and he has been shown arrested in connection with the instant case.

I have taken into account the period of detention of the present petitioner and the materials appearing against him i.e. he has been implicated on the basis of statement of co-accused and there has been no recovery from the present petitioner. Considering the same, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. As such, petitioner namely, Laxman @ Lakshman Ghosh shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Special Judge under NDPS Act, Nadia at Krishnanagar..

If on bail, the petitioner shall be physically present on each and every date so fixed before the learned Special Court and shall not leave the jurisdiction of district of Nadia without the prior permission of the learned Special Court. Accordingly, the application for bail being CRM (NDPS) No. 1645 of 2025 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
