Rakib (rejected) CRM (NDPS) 1646 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Bhimpur Police Station case no. 190 of 2024 dated 14.07.2024 under Sections 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges and has been implicated on the basis of the statement of the co-accused. There is 20,000 bottles of phensedyl which were recovered from the other accused persons and the petitioner is in custody since 18.08.2025.

On the other hand learned advocate for the State submits that there are monetary transactions between the petitioner and the principal accused which is rebutted by the learned advocate for the petitioner.

It has been additionally submitted on behalf of the petitioner that petitioner has been implicated because of political vendetta.

Be that as it may, it has been informed that all the accused persons are in custody. Copies have been supplied, next date has been fixed for consideration of charges. Having considered the same, I direct that learned trial Court to overcome the stage of consideration of charges at the earliest and from the next date so fix i.e. 22.01.2026 within a period of 60 days the seizure list witnesses be examined. Petitioner will renew his prayer for bail after the seizure list witnesses are over.

Accordingly, the prayer for bail of the petitioner in CRM (NDPS) 1646 of 2025 is dismissed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
