Mr. J.L.Roy ..for the petitioner Mr. Ranjit Rajak ..for the State Affidavit of service filed by the petitioner and report submitted by the State are taken on record.

Pursuant to the representation submitted by the petitioner, enquiry was made and upon hearing the parties, the Sub-Divisional Officer, Diamond Harbour SubDivision, by an order passed on July 16, 2025, directed the private respondents to remove the unauthorized construction in the plot in question within 15 days from the date of order failing which the Block Development Officer was authorized to remove the same and recover the cost of such removal from the private respondents. The Block Development Officer served notice upon the private respondents directing them to act in terms of the order passed by the Sub-Divisional Officer. This Court is informed that the unauthorized construction has not been removed till date.

In view of the above, the Block Development Officer, Mograhat Block -II, being the 4th respondent herein, is directed to act in terms of the order passed by the Sub-

Divisional Officer on July 16, 2025 within two weeks from the date of communication of this order.

The writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
