Ramesh Mahato And ORS. v. State Of West Bengal
20.12.2024 sdas Rejected C.R.M. (A) No. 4291 of 2024 In Re:- An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita in connection with Rishra Police Station Case No. 138 of 2024 dated 18.06.2024 under Sections 448/341/342/323/386/504/ 506/34 of the Indian Penal Code and Sections 25(1B)(a)/27 of the Arms Act.
And In Re : Ramesh Mahato & Ors. ..... petitioners Mr. Sandipan Ganguly, Sr. Adv.
Mrs. Manaswita Mukherjee .....for the petitioners Mr. Rudradipta Nandy, learned APP Ms. Sanjana Saha ..... for the State 1.
List of the criminal cases pending against petitioner no. 1 is placed on record.
2.
Learned Counsel for the State submits petitioner nos. 2 and 3 are his associates and carry on organised racket for extortion in the area.
3.
This is disputed by the learned Senior Counsel appearing for the petitioners. He submits most of the cases are old and his client i.e. petitioner no. 1 has been acquitted in seven of these cases.
4.
We have considered the materials on record including report regarding criminal antecedents. Report shows for more than one decade petitioner no. 1 is involved in a series
of cases. Even in the last two to three years cases have been registered against him alleging extortion. In light of the aforesaid materials on record disclosing involvement of the petitioner no. 1 in a series of extortion cases, we are of the opinion petitioner no. 1 is involved in an organised crime activity and this is not a fit case to grant anticipatory bail to him.
5.
With regard to petitioner nos. 2 and 3 we note there are materials to show that they are associates of petitioner no. 1 and had extorted the victim by showing firearms. Accordingly, we are not inclined to grant anticipatory bail to them also.
6. Accordingly, prayer for anticipatory bail is rejected. (Gaurang Kanth, J.) (Joymalya Bagchi, J.)
