Learned Senior Advocate appearing on behalf of the petitioner submits that the petitioner along with others were arraigned for alleged recovery of 34 Kgs. of Ganja. Petitioner is in custody since 2nd of August, 2024.

Charges have already been framed and witness action has started as such further detention of the petitioner is unwarranted.

Learned advocate for the State submits that out of 19 witnesses proposed to be examined, 6 witnesses have been examined.

Having considered the quantum of contraband seized, I am of the view Section 37 of the NDPS Act is attracted. Accordingly, I am not inclined to grant bail. Thus, CRM (NDPS) 1651 of 2025 is dismissed.

State is directed to expedite the process of trial and at least conclude another 10 witnesses within a period of 5 months. Petitioner will renew his prayer for bail after 30.04.2026.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
