Her appearance may be regularised by the concerned authority.
The grievance of the petitioners are that the trial relating to Thakurpurkur P.S. Case No. 37 dated 17.02.2020 is not progressing in spite of the charge(s) being framed. On several dates witnesses are not appearing before the court to depose and, such, the case is adjourned.
In view of the prayer so advanced by the petitioners, I direct that the ld. JM, 4th Court, Alipore, South 24 Parganas, henceforth, will communicate and inform for service of notice of summons to the witnesses through an officer deputed by the inspector in charge/officer in charge of Thakurpur P.S., who would ensure regarding the
availability of the witnesses or in the alternative, submit a report before the court that in spite of due diligence the witness(s) could not be traced out. Thereafter, the ld. Magistrate would proceed with the case at regular interval for the purposes of this case.
The Ld. Magistrate is directed to fix at least one date in every two months so that the trial of the case can be taken to its logical conclusion as expeditiously as possible. Ld. Public Prosecutor conducting the case would produce the materials, documents and the exhibits on the date so fixed for examination of the witnesses. All stakeholders would cooperate with the ld. trial court for completion of the trial as early as possible. With the aforesaid observations, CRR 4703 of 2023 is disposed of.
Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
