Parven ... for the Petitioner(s) Mr. Subhomay Bhattacharya Ms. Suchismita Dutta ... for the State-respondent(s) Learned advocate for the petitioner submits that from the joint possession of the petitioner and others allegedly 180 bottles of phensedyl were recovered and the petitioner is in custody for seven months. Learned advocate also submits that investigation has already been concluded and charge-sheet has been submitted before the jurisdictional court, as such, on any stringent condition, the petitioner may be released on bail.

Learned advocate for the State opposes the prayer for bail and submits that charge-sheet has been submitted against the five accused persons and two of the accused persons are absconding. According to the learned advocate, there are antecedents so far as the present petitioner is concerned.

Be that as it may, having regard to the period of detention, I am inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Manab Mandal shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under NDPS Act-cum-Additional District Judge, 4th Court, Malda.

If on bail, the petitioner shall appear on each and every date of the trial so fixed by the learned trial court and shall not leave the district of Malda without prior permission of the learned trial court/special court.

Accordingly, CRM(NDPS) 1654 of 2025 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
