The petitioner claims to be an award holder. The said award has been challenged by the opposite party herein by filing an application under Section 34 of the Arbitration & Conciliation Act, 1996 giving rise to Misc. Case No. (Arbitration) 70 of 2018. Record reveals that 04.01.2025 was fixed for hearing of the said misc. case and for filing of written arguments. On 04.01.2025, the written notes of arguments have been filed by the opposite party herein and 20.02.2025 has been fixed for filing of written arguments by the writ petitioner and for hearing of the aforesaid misc. case.

In view thereof, CO 4144 of 2024 is disposed of by requesting the learned Additional District Judge, 13th Court, Alipore, South 24 Parganas to take up the hearing of

the Misc. Case No. (Arbitration) 70 of 2018 on the next date fixed and to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties.

The petitioner shall be obliged to serve a copy of this application upon the learned counsel appearing for the opposite party in course of this day.

There shall, however, be no order as to costs. Urgent certified photostat copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Hiranmay Bhattacharyya, J.)
