1. Present applications have been filed for condonation of delay of about 18 days and restoration of the petition dismissed in default on 16th December, 2025.

2. Learned counsel for the petitioner submits that as the applicant remained unwell and busy in his medical treatment, he was unable to contract with his lawyer.

3. The Court has considered these submissions.

4. In view of the submissions made, the Section 5 application and the restoration application are, thus, allowed.

5. Petition is restored to its original file and number.

6. Issue notice to the opposite party no. 2. State of West Bengal be served through the Office of the learned Public Prosecutor.
