Mr. Tarak Karan ... for the State-respondent(s) Learned advocate for the petitioner submits that she is the owner in respect of a property and the private respondent nos. 4 and his associates are disturbing, threatening and attempting to encroach upon her property.

To that effect, an information was furnished with the Inspector-in-charge of Chakdaha Police Station on or about 17.10.2024. But, till date, the police authorities did not take any action.

Learned advocate for the State

submits that the dispute complained of is absolutely civil in nature.

In view of the contentions advanced by the petitioner, following directions are being passed:

1) The Inspector-in-charge or the Officer-in-charge of the Chakdaha Police Station would assess regarding the information furnished on 17.10.2024 and inform the outcome to the petitioner within a period of a fortnight.

2) In case, the outcome and/or the finality in the decision of the Officer-in-charge of the Chakdaha Police Station is not acceptable to the petitioner, the petitioner would be at liberty to approach the learned jurisdictional Court under Section 175(3) of the BNSS. The Learned Magistrate by

adhering to the provisions of law would pass necessary orders upon the Inspector-in-charge/Officer-incharge of Chakdaha P.S. In the meantime, the Inspector-incharge/Officer-in-charge of Chakdaha P.S. would ensure that strict vigil is kept on the property and no breach of peace and tranquility takes place as also no untoward incident results because of the inimical relationship existing between the petitioner and the private respondents.

With the aforesaid observations, WPA 28757 of 2024 is disposed of.

Report so submitted be kept with the record. Let a copy of the report be handed over to the learned advocate for the petitioner.
