Petitioner is aggrieved by the proclamation and attachment order which has been issued in connection with English Bazar Police Station Case No.1806 of 2022 dated 03.12.2022.

The learned advocate appearing for the petitioner submits that the petitioner was never aware regarding the case pending against him and without any knowledge the investigation has been taken to a logical conclusion and thereafter warrant of arrest, proclamation and attachment has been issued against him. As such the petitioner could not exhaust the remedies available under law.

The proclamation and attachment order so issued by the learned Special Court be kept in abeyance till 15th January, 2024.

If the petitioner appears, surrenders and prays for bail before the learned Special Court in connection with English Bazar Police Station Case No.1806 of

2022, the learned Special Court will consider his bail in accordance with law.

The execution of proclamation and attachment be stayed till as earlier directed till 15th January, 2024. On 16th January, 2024 the learned Special Court will give reminder to give effect to the attachment order so earlier issued.

With the aforesaid observations, CRR 4773 of 2023 is disposed of.

All the parties shall act on the server copy of this order duly downloaded from the official website of this court.
