The University has filed CAN 1 of 2024 seeking modification of the order and CAN 2 of 2024 has been filed for condonation of delay in filing the modification application.

The writ petitioners submit that the order dated April 18, 2024, has been complied with by providing them the rectified mark sheets. They have no further grievance in this regard.

The petitioners as well as the university, however, jointly submit for modification of the second part of the order whereby this Court permitted the petitioners to appear in the 5th semester examination along with the 6th semester examination.

The University submits that a standard practice of odd semester examinations and even semester examinations are taken separately. The University proposes that the petitioners should be allowed to sit in the 5th semester examination which is scheduled to be held sometimes in the month of December this year and in the 6th semester examination scheduled to be held in the month of June/July, 2025.

The petitioners have accepted the stand of the University.

Therefore, the order dated April 18, 2024, is modified to the extent that the petitioners will be allowed to sit in the 5th and 6th semester examination as scheduled by the University.

Accordingly, CPAN 1109 of 2024 along with CAN 1 of 2024 and CAN 2 of 2024 is disposed of. (Kausik Chanda, J.)
