The matter has appeared in the list under the heading 8To Be Mentioned9 for correction of the returnable date of the order dated 27th January, 2026. 2.

The returnable date of the order has been wrongly mentioned as March 2, 2026. The same ought to be read as <February 2, 2026=.

The order dated 27th January, 2026 is corrected accordingly. The remaining part of the said order will remain unaltered.

Let this order be read along with the order dated 27th January, 2026.

Accordingly, the writ petition is taken up for hearing today.

Learned advocate representing the State respondents relies upon the instruction forwarded by the Commissioner of School Education, West Bengal

signed on 30th January, 2026 wherefrom it appears that on receipt of a detailed report from the District Inspector of Schools (Secondary Education), North 24Parganas that the petitioner failed to discharge her duties properly, resulting in administrative failure, the respondent authority intends to initiate disciplinary action against her instead of permitting her to be transferred to some other school. Let the said instruction be taken on record.

It appears that the formal order cancelling the order of transfer of the petitioner has not been served upon the petitioner till date.

Let the order of cancellation of transfer be immediately communicated to the petitioner.

As the cause of action for which the writ petition was filed no longer survives and fresh cause of action has arisen with the issuance of the order of cancellation of the transfer of the petitioner, accordingly, no useful purpose will be served by keeping the writ petition pending.

The writ petition stands disposed of.

It will be open for the petitioner to initiate fresh proceeding challenging the subsequent cause of action in accordance with law, if so advised. 12.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
