Mr. Banerjee, learned Senior Advocate appearing for the petitioner submits on instruction that the sale notice, which had been challenged, has presently fructified into a sale. Thus, the cause of action for the present writ petition is not available any further.

However, he submits that since the sale notice is contrary to law and not sustainable, liberty is given to the petitioner to file a fresh proceeding, on the basis of such sale notice and sale conducted thereby.

Such leave is granted.

Accordingly, the writ petition is dismissed.
