Supplementary affidavit filed on behalf of the petitioner is taken on record.

By the present writ petition the petitioner seeks direction upon the respondent authorities for grant of family pension in her favour.

The petitioner contends that her father late Tarini Sen Manna was a Head Teacher of Agraiya Primary School, Post Office Kalsi, District Purba Medinipur. The petitioner's father retired from service on superannuation on 20th October, 1975. The father of the petitioner died on 30th March, 1998. The pension payment order was issued in favour of the father of the petitioner on 10th December, 2012 allowing the

equal share of arrear of family pension to five legal heirs. The mother of petitioner died on 21st December, 2009. The husband of the petitioner died on 15th December, 2021. The petitioner is the widowed daughter of the deceased employee. On 7th August, 2025, the petitioner made an application for grant of family pension in her favour. However, the same is still pending consideration. Hence this writ petition. 6.

Mr. Dilip Kumar Sadhu, learned advocate appearing for the petitioner submits that the matter be relegated to the appropriate authority for due consideration of the prayer of the petitioner for grant of family pension.

Mr. Joydip Banerjee, learned advocate representing the State submits that the prayer of the petitioner could not be considered as the petitioner is yet to produce the documents called for by the concerned authority vide letter dated 2nd February, 2026. However, in the event, such documents are produced, the authorities concerned will expeditiously consider the representation of the petitioner in accordance with law.

It is found that respondent no. 4, the District Inspector of Schools, Primary Education, Purba Medinipur vide letter dated 2nd February, 2026 has called for certain documents which are still to be produced by the petitioner before the concerned authorities.

Accordingly, respondent no. 4, the District Inspector of Schools, Primary Education, Purba Medinipur is directed to consider the representation of the petitioner dated 7th August, 2025 and dispose of the same in accordance with law by passing a reasoned order upon giving notice to the petitioner subject to production of the documents as per letter dated 2nd February, 2026 within a period of 12 weeks from the date of submission of such documents.

Such reasoned order shall be communicated to the petitioner within a period of one week from the date of passing of such order.

Learned advocate appearing for the petitioner is directed to communicate this order to respondent no. 4, the District Inspector of Schools, Primary Education, Purba Medinipur for necessary compliance.

With the aforesaid directions, the writ petition being WPA 28481 of 2025 is disposed of.

Since no affidavit is called for, the allegations made in the writ petition are deemed to have been denied. 14.

Consequently, connected applications, if any, stand disposed of.

Interim orders, if any, stand vacated.

16.

There shall be no order as to costs.

17.

Urgent photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
