Mohamad Masood ... for the State Learned counsel appearing on behalf of the petitioner submits that private respondent No. 1 encroached upon public land belonging to the Irrigation Department. Representation in this regard was made before the concerned SDO on 24.11.2023, but the same has not been responded to as yet. The State respondents submits that in the event any representation is pending in this regard, the same would be taken in accordance with law. No one appears on behalf of the private respondent despite service.

This writ petition is disposed of by directing the respondent No. 8 to consider the petitioner's representation to act in terms of Act 1962 in accordance with law and upon hearing the interested parties as expeditiously as possible, preferably within

eight weeks from the date of communication of this order.

It is clarified that as affidavits have not been called for, the allegations made shall be deemed not to have been accepted.

Urgent Photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
