Mr. De, learned advocate appearing on behalf of the CBI submits that the judgment was delivered by the learned special court on 31st July, 2023 and the present special leave to appeal was preferred on 6th December, 2023.

Having considered that this special leave to appeal and the prosecution is entitled to a period of six months for preferring such application the departmental comment for preferring an application for condonation of delay is unwarranted.

Accordingly, the special leave to appeal is taken up for hearing. I find that the ground so assigned in the application praying for leave to prefer an appeal are just and sufficient, as the prosecution is aggrieved regarding the order relating to acquittal. Thus, CRMSPL 77 of 2023 is allowed. The applicant is granted liberty to file memorandum of appeal within the statutory period. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
