1. The documents have produced before this court. Affidavit of compliance filed by the Pradhan, alleged contemnor, indicates that an enquiry was made with the help of the Revenue Inspector. A sketch map has also been annexed to the report, which shows that plot no. 3262 over which the writ petitioner had alleged unauthorized construction, is a 'Pukur', and there does not appear to be any existing construction on the said plot.

2. Learned Advocate for the petitioner submits that such finding is incorrect.

The petitioner had adequate documents and photographs to indicate that construction on the Pukur had been carried out by the respondent no.4, in the writ petition.

3. In my view, the merits of the order cannot be decided in this proceeding. The writ petitioner is granted liberty to challenge the order by initiating a proper proceeding along with all documents in support of the claim that the finding of the gram panchayat is erroneous.

4. Under such circumstances, the contempt application is disposed of. Contempt proceeding is dropped.

5. Personal appearance of Barnali Bag is dispensed with. Rule is discharged.
