And In the matter of : Hasina Begum ...... petitioner Mr. Sekhar Kumar Basu, Sr. Advocate Mr. Soubhik Mitter, Mr. Sayan Das ....for the petitioner Mr. Partha Pratim Das, Mr. Apurba Kumar Datta ....for the State Mr. Mridul Biswas ....for the de facto complainant A writ petition was filed before this Court relating to defalcation of funds with regard to a Gram Panchayat. Such writ petition was disposed by an order directing enquiry. An enquiry was conducted. Enquiry found various aspects were required to be investigated into a criminal proceeding. Criminal complaint was lodged.

Petitioner before us is the ex-Pradhan of the concerned Gram Panchayat under whose tenure, the instances of wrong doings were found. Role of the petitioner in the incident requires investigation. Enlarging the petitioner on anticipatory bail will be inimical to such investigation.

Consequently, we are unable to grant anticipatory bail to the petitioner.

This application for anticipatory bail is, thus, rejected. CRM(A) 5485 of 2023 is disposed of.
