Learned advocate appearing for the petitioner submits that petitioner is in custody for one year six months and the case till date has not been committed, as such petitioner may be released on bail. Mr. Gauranga Kr. Das, learned Additional Public Prosecutor along with Ms. Nayana Mukhopadhyay are appearing for the State. Their appointments may be regularized by the concerned authorities.

Learned advocate appearing for the State has produced the Case Diary as also referred to the seizure memo which reflects that dead body was recovered from the north-eastern corner of a fishery of Pradip Maity. Petitioner is the sister-in-law. The other evidence in the case do support the prosecution case and some of the accused persons are still absconding. Post-mortem reflects that the deceased was strangulated to death.

Having considered the complicity of the present petitioner, at this stage, I am of the opinion that this is not a fit case for granting bail.

It has been informed that the case is still pending before the learned A.C.J.M., Haldia, learned Magistrate is directed to split up the trial by exhausting the process of law and by adhering to the provisions of Section 232 of the BNSS commit the case at the earliest to the Court of Sessions.

Accordingly, CRM (M) 2723 of 2025 is dismissed at this stage.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
