In compliance with the direction passed on April 27, 2023 Mr. Haque, learned Advocate for the petitioner files an affidavit, let it be kept with the record.

The petitioner was the Headmaster of Suri Public Chandra Gati Mustafi Memorial High School, District : Birbhum. On superannuation he retired from his said service on November 30, 2021.

The petitioner is praying disbursement of his pension along with arrear increments for the period from July 01, 2006 to October 31, 2014.

To resolve the issue, by an order dated April 27, 2023, the District Inspector of Schools (S.E.), District : Birbhum, the respondent no.4 herein was directed to convene meeting with the petitioner on two successive days. The said respondent for his pre-occupation could not hold such meeting for two days but has addressed the issue in a single meeting.

Mr. Singh learned advocate for the State, files a report bearing Memo No. 173/1(1)/LS dated June 26,

2023 regarding the outcome of the said meeting. Let it be kept with the record.

The report says that the petitioner is not entitled to two additional increments for acquiring Ph.D. degree with effect from July 01, 2006 but he is entitled to increment with effect from February 24, 2006 i.e. the date of convocation of the petitioner for the said Ph.D degree and for disbursement of the pension, the petitioner has been advised to re-submit the rectified service book upon recasting the pay, after adjustment of overdrawn amount and to comply with all objections.

The aforesaid decision of the respondent no. 4 does not call for any interference. The petitioner is at liberty to follow the advice of the said respondent for disbursement of his pension.

W.P.A. 28612 of 2022 is disposed of with the above observations without any order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
