Re: CRAN/1/2023 Learned advocate appearing for the petitioner submits that there has been delay of 227 days in preferring this revisional application.

Having regard to the reasons assigned to the revisional application, I am of the view that the same are just and sufficient.

Accordingly, the delay is condoned.

CRAN 1 of 2023 is allowed.

Re: 4722 of 2023 Petitioner has prayed for interference in respect of the interim maintenance awarded by the learned Judicial Magistrate, 1st Court, Chanchal, Malda in connection with a proceeding under Section 125 of the Code of Criminal Procedure.

I find that the learned Magistrate after assessing the initial materials which were placed by way of affidavit of assets and liabilities awarded interim maintenance of Rs.5,000/- per month.

Having regard to the present case, I am not inclined to interfere with the said order. If there are materials which, according to the petitioner, would enure to his benefit in course of the trial the same be brought in evidence and the learned trial court at the end of the trial would arrive at its independent finding which may be different from the interim maintenance so awarded.

With the aforesaid observations, CRR 4722 of 2023 is disposed of.

All the parties shall act on the server copy of this order duly downloaded from the official website of this court.
