1. On earlier occasion i.e. 11.12.2025 the matter was heard in extenso, restraining the authorities from taking any coercive steps till the next date of hearing.

2. Since the matter is pending before the ESI Court since 2002 an expeditious hearing is warranted. Form the record it appears that the next date of hearing has already been fixed on 19.01.2026 by ESI Court.

3. The ESI Court is directed to hear the Misc. Case 23 of 2025 peremptorily on the even date.

4. In the event, if the applicant succeeds, the ESI Court shall conclude the entire hearing of the matter on merits forthwith, preferably within a period of 60 days from the date of consideration Misc. Case 23 of 2025 in accordance with law.

5. The Recovery Officer is restrained from taking any coercive steps till the disposal of the Misc. Case 23 of 2025 pending before the ESI Court.

6. The writ petition being WPA 28423 of 2025 is disposed of.

7. Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.
