Mr. Suman De ...for the State Mr. Somnath Banerjee ...for the opposite party no.2 Mr. Suman De, learned advocate appearing for the State at the inception of the case submits certified true copy of the Case Diary of Chanchal Police Station Case No.114 of 2010 dated 04.05.2010 (G.R. Case No.1470 of 2010).

Let certified true copy of the Case Diary be kept with the record.

The said Case Diary at the last page refers to the report under Section 173 of the Code of Criminal Procedure which concludes as:

"I submitted FRMF vide Chanchal PS FRMF No.751/19 dt. 18/10/19 u/s 153/153A/295A R/W/Sec SC/ST 3(1)(X) Prevention

of Atrocity Act. So I pray before your kind honour that the persons namely (1) Dipankar Rakshit S/O Amalendu Sekhar Rakshit of Chanchal College Road, PO+PS Chanchal, Malda reporter of Uttar Banga Sambad (2) Shyama Prasad @ Ratan Chakraborty S/O Lt Shanti Ranjan Chakraborty News Editor Uttar Banga Sambad, Malda with Office at Sadarghat More, Bulbulchandi Road, PS Old Malda Dist Malda may kindly be discharged them from this case. I informed the complainant about the result of the case." Mr. Somnath Banerjee, learned advocate appears on behalf of the opposite party no.2 representing the High Court State Legal Aid Services Authority. His appointment may be regularized by the concerned department.

As the report submitted by the State reflects that a prayer was advanced by the investigating authorities for discharge the purpose of the present revisional application is already frustrated. The revisional application is infructuous.

Accordingly, criminal revisional application being C.R.R.3562 of 2010 is dismissed. All the connected applications are accordingly disposed of.

Interim order, if any, is hereby vacated.

Department is directed to communicate this order to the concerned authorities.

All parties shall act in terms of copy of this order downloaded from the official website of this Court.
