Mr. Upendra Roy Mr. Kanchan Roy .....for the petitioner Mr. Saptangsu Basu Mr. Ashok Kumar Jena ....for the respondents 1) Affidavit of service filed on behalf of the petitioner is taken on record.

2) Petitioner's husband was an employee of Syama Prasad Mookerjee Port. Husband diedin-harness on 24th July, 2022. In the present writ petition prayer has been made for payment of death gratuity and other benefits which are payable to the petitioner being widow of deceased employee in accordance with law.

3) During course of hearing, Mr. Basu, learned Senior Advocate representing the Port Authorities has placed a copy of letter dated 27th September, 2023 issued by the Senior Accounts Officer, Pension Section, Syama Prasad Mookerjee Port addressed to the petitioner thereby petitioner was requested to submit bank particulars of legal heirs of

deceased employee for disbursing proportionate death gratuity in their favour. Same is taken on record.

4) It is submitted on behalf of the Port Authorities that if bank particulars are submitted necessary steps shall be taken for release of proportionate death gratuity in favour of legal heirs of deceased employee.

5) In view of submissions made on behalf of the parties and taking note of the letter dated 27th September, 2023 of the Senior Accounts Officer, Pension Section petitioner shall be at leave to submit bank particulars of legal heirs of deceased employee before the respondent no.4 by fortnight from date. If bank particulars are submitted within aforesaid time concerned Port Authority is directed to release proportionate death gratuity to the petitioner and other legal heirs by four weeks thereafter, if same is not paid in the meantime.

6) Petitioner shall also be at leave to make a representation seeking release of Provident Fund and Leave Encashment benefits before the Financial Adviser and Chief Accounts Officer, Syama Prasad Mookerjee Port being respondent no. 4 by three weeks from date. If such representation is made within aforesaid time, respondent no. 4 shall decide same in

accordance with law by eight weeks thereafter and decision to be communicated to the petitioner by ten days thereafter.

7) Writ petition stands disposed of.

8) There shall be no order as to costs.

9) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
