WPA No. 27509 of 2023 Avijit Rao Vs.

CESC Limited and another Mr. Indranil Halder ... for the petitioner.

1. A report is filed today in court by the CESC Limited which indicates that there are safety issues involved if additional wires are to be affixed to the existing electricity meter at the premises of the petitioner, which is a hutment, for giving a fresh commercial connection over and above the existing domestic supply.

2. If a commercial connection is to be given, it is submitted, it would create a safety and fire hazard for all concerned.

3. Since the court ought not to readily override the valid concerns of the Distribution Licensee, which is the expert in the field, the appropriate remedy is for the petitioner to approach the concerned Grievance Redressal Officer (GRO) with the dispute as raised above.

4. If so approached, the GRO shall decide all the issues between the parties by giving adequate opportunity of hearing to all concerned and also giving opportunity to the parties to produce relevant documents, if so required.

5. Such exercise shall be concluded by the GRO as expeditiously as possible, positively within six weeks from the date of communication, by acting on a server copy of this order.

6. The report filed by the CESC Limited be kept on record.

7. WPA No. 27509 of 2023 is disposed of in the light of the above observations.

8. There will be no order as to costs.

9. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities. (Sabyasachi Bhattacharyya, J.)
