On prayer of the petitioner, liberty is granted to implead Assistant Engineer, PWD Roads, Nadia Highway, Division - II, Nadia, as respondent no.11 in the writ petition.
The cause title of the writ petition be amended accordingly.
The petitioner is directed to serve a copy of the writ petition along with all annexures thereto upon the 11th respondent in course of the day.
The petitioner complains of unauthorised construction raised by the private respondents by encroaching upon a portion of PWD road. The petitioner seeks liberty to submit a comprehensive representation in this regard before the concerned authority and prays for a
direction upon the concerned authority to consider the representation at the earliest.
It is submitted on behalf of the State respondents that the 11th respondent be directed to consider the representation in accordance with law.
In view of the above, the writ petition being WPA 28646 of 2022 is disposed of with liberty to the petitioner to submit a comprehensive representation within seven days from date. The 11h respondent is directed to consider and dispose of the representation submitted by the petitioner within three months from the date of receipt thereof upon affording reasonable opportunity of hearing to all the interested persons including the petitioner and the respondents, in accordance with law.
Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. There shall however, be no order as to costs. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
