Allowed C.R.M. (M) 2732 of 2025 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with Jetia Police Station Case No. 182 of 2024 dated 11.11.2024 under Sections 103(2)/238/61(2)(a)/3(5) of the Bharatiya Nyaya Sanhita, 2023.

And In Re :

Silan Marjit ... Petitioner.

Mr. Debasis Kar, Mr. Arka Tilak Bhadra, Ms. Paromita Mukherjee ... For the Petitioner.

Mr. Bibaswan Bhattacharya, Mr. Dipankar Paramanick ... For the State.

Learned advocate appearing for the petitioner submits that he is in custody for more than a year and similarly placed accused persons have been granted bail. Records reflect that some of the accused persons were granted bail in CRM(M) 1966 of 2025, CRM(M) 1971 of 2025 and CRM(M) 2589 of 2025. Records of the case also reflect that the petitioner is similarly situated as the other accused persons who have been granted bail.

Two of the accused persons are still absconding as has been informed by the learned advocate appearing for the State.

Having considered the period of detention of the petitioner and the petitioner being similarly placed as other accused persons who have been granted bail, I am inclined

to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner viz., Silan Marjit shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Barrackpore, North 24-Parganas. If on bail, the petitioner shall be physically present on each and every date so fixed by the learned court in seisin of the case including the learned Trial Court and shall not leave the jurisdiction of the district of North 24-Parganas without prior permission of the learned Trial Court or the learned Additional Chief Judicial Magistrate, Barrackpore. In case there is violation of any condition, the court in seisin of the present case would be at liberty to cancel the bail of the petitioner without further reference to this Court. Report submitted by the learned advocate appearing for the petitioner be kept with the record.

The application for bail, being CRM (M) 2732 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
