06.01.2026 Court No. 02 Item No.10 (Suvendu) WPA 28495 of 2025 ARITRA GHOSH -Versus- UNION OF INDIA & OTHERS Mr. Debasish Kundu .....for the petitioner Mr. Partha Ghosh Mr. Jasojeet Mukherjee ....for the UOI 1) Matter is taken up for consideration in presence of learned advocates representing the petitioner and Union of India.
2) Report dated 1st January, 2026 signed by the Commandant (Estt) on behalf of Inspector General, Border Security Force, South Bengal Frontier is filed today and same is taken on record.
3) It is disclosed in report dated 1st January, 2026 that in Review Medical Examination conducted on 2nd December, 2025 it was found that petitioner was having epidermal nevus on left hypochondrium region and petitioner was sent to JNM Hospital Kalyani for specialist opinion. The dermatologist of said hospital opined that it was a case of 'verrucous epidermal nevus (L) hypochondrium lateral aspect' as a result whereof Review Medical Examination Board declared the petitioner unfit.
4) Reliance is also placed on the relevant part of the guideline which provides that congenital or acquired anomalies of the skin
such as nevi or vascular tumors are grounds for declaring a candidate medically unfit.
5) This Court is not an expert in the medical field and as such Court has to consider Review Medical Examination report on the anvil of relevant guidelines.
Moreover, object of medical examination of a civilian by a general medical practitioner/ hospital and medical examination by experts in Detailed Medical Examination or Review Medical Examination for the purpose of recruitment is completely different as standards of medical fitness for recruitment in disciplined forces are stringent and require assessment as per guidelines.
6) Therefore considering the Review Medical Examination report dated 2nd December, 2025, no relief can be granted to the petitioner and writ petition stands dismissed.
7) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
