Since the petitioner seeks expeditious disposal of the application under Section 127 of the Code of Criminal Procedure registered as Misc. Case 75 of 2022 pending before the learned Judicial Magistrate, 1st Court, Barrackpore, North 24 Parganas, the matter may be taken up for consideration without service of notice upon the opposite parties.

The opposite parties shall not be prejudiced by an order directing expeditious disposal of the case. It appears that the petitioner filed the application for enhancement of maintenance under Section 127 of the Code of Criminal Procedure on 22nd March, 2022 which was registered as Misc. Case 75 of 2022. There is no reflection in the order sheets of the learned Trial Court

with regard to hearing of the said application. Only the application under Section 125 of the Code of Criminal Procedure is being proceeded with.

The learned Trial Court is directed to take the application under Section 127 of the Code of Criminal Procedure to its logical conclusion within two months from the date of communication of this order upon granting reasonable opportunity of hearing to both the parties and without granting any unnecessary adjournment to either of the parties, in accordance with law.

The revisional application being CRR 5136 of 2024 is disposed of.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
