The revisional application is fixed up today for hearing. None appears for the petitioner.
Petitioner preferred this revision against an order dated 19.8.2014 passed by learned Chief Judicial Magistrate, Birbhum in Misc. Execution Case No. 22 of 2012 relating to issue of distress warrant arising out of Misc. Case No. 83 of 2009 under Section 125(3) of the Cr.P.C. In order dated 19.9.2014, the petitioner was directed to pay 50% of the outstanding amount to his wife/opposite party and the balance amount within three months in equal instalments and to pay the regular maintenance in addition to such payments. An interim order was passed staying further proceedings in Misc. Execution Case no. 22 of 2012 on condition that there should not be a single default. Having considered the observations made earlier by this Court and the fact that the petitioner has not appeared thereafter, it can be presumed that the object of Misc. Execution Case No. 22 of 2012 arising out of Misc. Case No. 83 of 2009 has been sub-served. Accordingly, the revisional application stands dismissed for default. The same is also disposed of.
