The revisional application is listed today for hearing. None appears for the petitioner.
There is no indication that order dated 19.9. 14 directing the petitioner to pay Rs.5,000/- to the opposite party within seven days has been complied. The revisional application has been filed by the husband challenging order dated 10.7.2014 passed by learned Judicial Magistrate, 1st Court, Tamluk in Misc. Execution No. 30 of 2012 arising out of Misc. Case No. 75 of 2010 under Section 125 (3) of the Cr.P.C. The petitioner/husband has prayed for a stay of Misc. Execution Case on the ground that in Misc. Execution Case No. 30 of 2012, a distress warrant has been issued against him due to non-payment of maintenance. The petitioner has not come forwarded nor is he represented to indicate that he has complied the court's order made earlier. The revisional application is therefore dismissed for default. Interim order staying of further proceeding of the Execution Case, if any, is vacated.
