Learned advocate appearing for the petitioner submits that the petitioner is in custody for two years three months and it has been submitted that there are no eye-witnesses to the case and on surmises and conjectures petitioner is detained in custody. Learned advocate appearing for the State submits that out of 26 witnesses cited in the charge-sheet 19 witnesses have already been examined.
In view of the period of detention of the present petitioner, I direct the learned trial Court to conclude the prosecution witnesses within a period of six months from the next date fixed. It is categorically stated that no unnecessary adjournment be granted to any of the parties and in case an examination-in-chief of a witness is completed only under exceptional circumstances the cross-examination should be shifted to another date.
The trial of the case would continue in spite of any resolution of the local bar and the learned trial Court in spite of the schedule will try to complete all the witnesses prior to the schedule fixed. At this stage the prayer for bail of the petitioner is refused, however, the petitioner would be at liberty to approach this Court after the schedule is over.
Accordingly, with the aforesaid observations CRM (M) 2731 of 2025 is dismissed.
