Learned advocate appearing for the petitioner prays for cancellation of order of bail dated 05.10.2024 passed by the Learned CJM, Barasat, 24 Parganas North. According to the learned advocate, the case diary was never called for and on the accused persons surrendering before the learned Court, they were granted bail without consideration of the case diary. Learned advocate for the State has submitted a report. Report reflects that the accused opposite party has complied with the notices issued under Section 35(3) of the BNSS. The investigation of the case is still under progress. The vehicle has already been seized by the police authorities. Further materials

are being collected by the Investigating Agency which is being monitored by an officer in the rank of Deputy Commissioner of Police, Detective Department, Bidhannagar.

Having considered the notices under Section 35(3) of the BNSS were complied with and the accusations for which the investigation is going on, I am of the opinion that no interference is called for in respect of the order of the bail granted by the learned CJM, Barasat, 24 Parganas North on 05.10.2024. However, since the investigation is still in progress, the accused opposite party will make herself available as and when called for by the Investigating Officer and shall not leave the jurisdiction of Kolkata and 24 Parganas North without prior intimation to the Investigating Officer. With the aforesaid observations CRM (SB) 162 of 2024 is disposed of.

Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
