Affidavit-of-service filed by the petitioners be kept with the record.

Petitioners are aggrieved as the petitioners were obstructed from entering their property because of an illegal construction being made at the behest of the private respondents. To that effect, petitioners filed a writ petition being WPA 24784 of 2024. Immediately on the said writ petition being filed, the private respondents started threatening and abusing the petitioners for which the petitioners were feeling insecured and in spite of informing the police authorities, no steps were taken.

Learned advocate appearing for the State has submitted a report. Report reflects that a proceeding

under Section 126 of the BNSS was drawn up by the police authorities for maintaining peace and tranquility.

Since steps were taken by the police authorities in respect of the threat and abuses complained of by the petitioners, I direct that the police authorities would continue to keep strict vigil and ensure that no untoward incident results between the petitioners and the private respondents because of the strained relationship existing between them.

With the aforesaid observations, WPA 28813 of 2024 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioners. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
