Learned advocate appearing for the petitioner submits that the petitioner is in custody since 20.06.2024; although case has been committed, but till date, witness action has not commenced. Learned advocate for the petitioner has relied upon the order dated 30.03.2026 passed by this Court in CRM(M) 494 of 2026 (Lukman Sk Vs. The State of West Bengal) and prayed for bail.

Learned advocate appearing for the de facto complainant opposes the prayer for bail.

Learned advocate appearing for the State opposes the prayer for bail and draws the attention of the Court to the statement of one of the witnesses recorded under Section 164 of the Code of Criminal Procedure.

I have taken into account the locus of the accused person viz. Lukman Sk who has been granted bail on 30.03.2026 in CRM(M) 494 of 2026. Having considered the same, I am of the opinion that the present petitioner is not differently placed as the other accused who has been granted bail in CRM(M) 494 of 2026. As such, the present petitioner viz., Jahedul Sk @ Jahidul Sk be released on bail by the learned Trial Court being the learned CJM, Murshidabad at Berhampore on the same terms and conditions as the other accused who has been granted bail in CRM (M) 494 of 2026. Accordingly, the prayer for bail of the petitioner is allowed.

Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. Mr. Gouranga Kumar Das, learned APP along with Ms. Nayana Mukhopadhyay, learned advocate was directed to appear on behalf of the State. Their appointment may be regularised by the concerned authorities.

The application for bail, being CRM (M) 2734 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
