Affidavit of service filed on behalf of the petitioner is taken on record.

By the present writ petition the petitioner seeks direction upon the respondent authorities to approve the service of the petitioner as Assistant Teacher from the year 2017 upon consideration of representation dated 13th August, 2025.

The petitioner contends that she participated in the selection process of the year 2016. The petitioner filed a writ petition being WP 25768(W) of 2017 challenging the wrong questions of TET 2014. The writ petition was disposed of declaring the six questions of TET-2014 as wrong and further directed to award six marks to the petitioner and give her appointment. Since the appointment was not given to the petitioner, the petitioner filed a contempt

application and Rule was issued being WPCRC 234 of 2019. Thereafter on 4th October, 2021 appointment letter was issued to the petitioner who joined on 5th October, 2021. Similarly circumstanced candidates were given appointment in the year 2017. The petitioner on 13th August, 2025 the petitioner made a representation for approving her service notionally from the year 2017. However, the same is still pending consideration. Hence this writ petition. 4.

Ms. Ankita Dey, learned advocate for the petitioner submits that the matter may be relegated to the appropriate authority for considering the representation of the petitioner in accordance with law.

Mr. Avishek Prasad, learned advocate appearing for the DPSC, Malda and Mr. Krishna Pada Santra, learned advocate for the State leave the matter to the discretion of the Court.

In view of the submissions advanced, respondent no.3, Commissioner of School Education, Government of West Bengal is directed to consider the representation of the petitioner dated 13th August, 2025 and dispose of the same by passing a reasoned order in accordance with law upon notice to the petitioner within a period of eight weeks from the date of communication of this order.

Learned advocate for the petitioner is directed to communicate this order to the respondent no.3,

Commissioner of School Education, Government of West Bengal for necessary action.

With the aforesaid directions, the writ petition being WPA 28537 of 2025 is disposed of.

Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.

10.

Interim order, if any, stands vacated.

11.

All connected applications, if any, stand disposed of. 12.

There shall be no order as to costs.

13.

All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

14.

Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
