Petitioners have challenged the proceedings arising out of Entally PS Case No.326 dated 28.6.2015. In the said case after conclusion of investigation charge-sheet was submitted.

The only grievance which I find is that the de facto complainant being an aged lady is not appearing in the court for deposing in connection with the instant case.

Petitioners are directed to serve a copy of the revisional application upon Mr. Mahata, learned advocate, who ordinarily appears on behalf of the State. His appearance may be regularized by the concerned authority.

In view of the nature of the grievance so expressed and the fact that the case was initiated in the year 2015, I direct the learned Magistrate to fix at least one date ina month so that the trial can be concluded at the earliest. If the de facto complainant is not appearing in that case, the Officer-in-Charge of Entally Police Station would be communicated so that he would

be in a position to submit a report before the court regarding the availability of the witness concerned. It is further directed that if no witness appear for three consecutive occasions, the evidence of the said witness should be closed after taking a report from the concerned Police Station.

All efforts be taken to conclude the trial by 31st December, 2025.

Accordingly, CRR 4718 of 2023 is disposed of. All the parties shall act on the server copy of this order duly downloaded from the official website of this court.
