Kausik (Rejected) CRM (M) 2751 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Baishnabnagar Police Station 160 of 2019 dated 30.03.2019 under Sections 363/342/109/506/34 of the Indian Penal Code read with Section 6 of the POCSO Act.

Memo of Evidence submitted be also kept with the record.

Learned advocate for the State submits that petitioner is in custody for 1 and half years and till date only evidence of the victim has partially been completed.

Learned advocate for the State has produced the case diary and drawn the attention of the Court to the statement of the victim under Section 164 of the Cr.P.C.

Having considered the evidence that is of the victim, till date is not completed, I am not inclined to grant bail to the petitioners.

At this stage, prayer for bail of the petitioners in CRM (M) 2751 of 2025 is rejected.

Learned Trial Court would within a period of 3 months from the date of communication of this order complete the evidence of the victim.

Petitioner will renew his prayer for bail after the aforesaid period is over.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
