Learned advocate appearing for the petitioner submits Bpg.
Allowed that the petitioner is in custody for 413 days and 6 witnesses have already been examined out of the cited 19 witnesses in the chargesheet. Learned advocate submits that 5 witnesses have turned hostile.
Learned advocate for the State has produced the case diary and submitted that it is the mother of the present accused who is the deceased and has been murdered.
Be that as it may, on perusal of the documents which have been enclosed by the petitioner, it reflects that all the vital witnesses who have been cited in the charge-sheet have turned hostile.
Having regard to the same, I am of the view that further
detention of the petitioner is not warranted in connection with the instant case. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner, namely, Koushik Singha @ Chayan Singha shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned CJM, Malda. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the district of Malda without the prior permission of the learned trial court.
Accordingly, CRM(M) 2742 of 2025 is allowed.
