The present writ petitioner is the permanent stage carriage permit holder with respect to the Inter-State route from Kolkata Central Bus Terminus at Santragachi to Puri via Jamsola.

The petitioner so far has been plying a vehicle being WB 41H/0615, which he intends to replace with another vehicle of Bharat Stage -IV compliance. 4.

To that effect, he has prayed before the Secretary, State Transport Authority, West Bengal vide its letter dated August 29, 2024, for grant of permission, but to no avail, as yet.

The petitioner seeks an order in this writ petition directing the said respondent authority to immediately consider his prayer in the said letter as mentioned above and grant him permission to replace his old vehicle as mentioned above.

In view of the innocuous prayer of the petitioner, let this writ petition be disposed of with the direction upon the Secretary, State Transport Authority, West

Bengal to consider the petitioner's representation dated August 29, 2024 immediately but positively within a period not beyond three weeks from the date of communication of copy of this order.

He shall afford opportunity of hearing to the petitioner and pass a reasoned order as to the prayer made by the petitioner in the said letter dated August 29, 2024.

Its decision shall be communicated to the petitioner within one week from the order.

Since no affidavit is invited, the allegations contained in the petition are deemed to have been denied by the respondents including the private respondents.

10. With the above observations and directions, the writ petition being WPA 28933 of 2024 is disposed of, along with the pending applications, if any.

11. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
