The instant revisional application has been filed seeking a direction upon the learned Special Court-II-cum-Additional Sessions Judge, 1st Court Howrah for expeditious disposal of the Special Case No. 12 of 2008 arising out of Uluberia P.S. Case No. 477 dated September, 3, 2008.

Having heard the submissions made on behalf of the learned Advocate for the petitioner and upon going through the materials on record including the copy of the order sheet annexed in the application it transpires that in a case being Uluberia P.S. Case 477 dated September 3, 2008, charge sheet was submitted on 8th December, 2010. The case was committed to the Court of Sessions and there after charge sheet stood framed.

At the time of hearing learned Advocate for the petitioner submits that seven out of ten charge sheeted witnesses have been examined by the prosecution. The last witness was examined in March, 2024.

Learned Advocate for the petitioner submits that since then no witness has been examined though the case has been fixed for recording evidence for prosecution.

In the facts and circumstances of this case as noted above, it would be appropriate to request the learned Special Court-IIcum-Additional Sessions Judge, 1st Court Howrah to try and dispose of the Special Case No. 5 of 2011 as early as possible without granting any unnecessary adjournments to either of the

parties. No doubt, learned Special Court-II-cum-Additional Sessions Judge, 1st Court Howrah shall take all steps to secure attendance of the prosecution witnesses, if any, in accordance with law.

With such observation, the revisional application CRR 5381 of 2025 is disposed of.
