21.09.2023 sdas rejected C.R.M.(NDPS) No. 1535 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Basirhat Police Station Case No. 801 of 2021 dated 03.11.2021 under Section 21(c ) of the NDPS Act.

And In Re : Suman Adhikary .... petitioner Mr. Angshuman Chakraborty Mr. S. S. Saha ....for the petitioner Mr. Sudip Ghosh Mr. Bitasok Banerjee ...... for the State

1. Chemical report has been placed before the trial court.

2. Report shows presence of codeine phosphate. Materials on record shows recovery of 5 liters of codeine phosphate from the petitioner which is above commercial quantity.

3. Under such circumstances and in view of statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.
