Ghosh ... for the Petitioner(s) Mr. Abhishek Sinha Mr. Sobhan Gani ... for the State-respondent(s) Learned advocate for the petitioners submits that from the joint possession of the petitioner allegedly there were recovery of 590 bottles of phensedyl and the investigation has been completed and charges have been framed. According to the learned advocate, there is no possibility of the trial concluding in the near future, as such, he prays that the petitioners may be released on bail. Learned advocate for the State opposes the prayer for bail and submits that commercial quantity of contraband has been seized.
Be that as it may, having considered the period of detention as also taking into account the quantum of seizure, I am of the view that further detention of the petitioners is unwarranted.
Hence, the prayer for bail of the petitioners is Allowed.
Accordingly, the petitioners viz, Sohel Sekh, Sahbul Sekh @ Sahbul Sekh and Muzzemel Sekh @ Mojammel Sk shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only) each, with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under NDPS Act-cum- Additional District & Sessions Jude, 2nd Court, Berhampore, Murshidabad.
If on bail, the petitioners shall appear on each and every date of the trial so fixed by the learned trial court and shall not leave the district of Murshidabad without prior permission of the learned trial court/special court. Accordingly, CRM(NDPS) 1660 of 2025 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
