In the absence of the petitioner who was on bail in connection with G.R. Case No. 162 of 2022 on 9th September, 2022 the learned Senior Municipal Magistrate, Kolkata issued warrant of arrest against the petitioner. The petitioner has approached this Court to recall the warrant of arrest.

I do not find any merit in the instant revision. The revisional Court cannot be used as a tool to overturn the order of the trial Court

which was passed considering the facts and circumstances of the case.

It is submitted by the learned advocate for the petitioner that the petitioner is an advocate. If he is taken to custody, it will be shameful for him.

The petitioner is at liberty to make the same submission before the trial Court and the learned Senior Municipal Magistrate shall consider such submission, if made at all, and pass the order upon such application in accordance with law.

The instant revision is, thus, disposed of.
