Mr. Samim Ahammed Mr. Arka Maiti ... ... for the petitioners Mr. Jahar Lal De Mr. Supratim Dhar ... ... for the State In this public interest petition the residents of Arjunpur Gram Panchayat, Murshidabad have raised a grievance that defalcation has been done in the implementation of various projects under MGNREGA Scheme. In paragraphs 3 and 4 of the petition the petitioners have disclosed various projects which were taken under the Scheme and alleged defalcations and irregularities in implementation thereof.

Learned counsel for the petitioners has referred to the mass representation dated 21st September, 2022 made to the BDO, Farakka Block wherein the details of irregularities and misappropriations have been mentioned.

Learned counsel for the State has fairly submitted that if the petitioners file representation before the respondent no.2, District Magistrate and Collector, Berhampore, Murshidabad then the grievance can be duly looked into.

Hence, we dispose of the present public interest petition by permitting the petitioners to file a detailed and

comprehensive representation with all particulars and supporting materials before the respondent no.2 who on receipt of the same will get an enquiry conducted, if required and will take appropriate decision in accordance with law after giving opportunity of hearing to all the concerned parties.

Let this exercise be completed within a period of three months from the date of receipt of the representation along with the copy of this order. Petition is accordingly disposed of.
