Sufficient cause being shown for non-appearance on the date when the appeal was dismissed for default. The order dated 28th March, 2023 is recalled and the appeal is restored to its original file and number.

Interim order, if any, is revived.

CAN 3 of 2023 is, thus, disposed of.

In Re: FA 340 of 2023 The department has reported that in spite of communication of the orders dated 21st December, 2022 and 15th December, 2022, LCR has not arrived. The communication received from the learned Trial Court is placed before us.

A reminder shall be sent to the learned Trial Court for sending the LCR without any further delay and in any event, within two weeks from the date of communication of this order. The learned Registrar Administration (L&OM) is directed to

ensure compliance of this order.

A copy of this order shall also be forwarded to the learned District Judge, Howrah, to ensure compliance of this order. While sending the LCR, the learned Trial Court must ensure that the LCR is in order and without any defect. Soon after arrival of the LCR, the department shall examine the same and if it is found complete, shall serve notice of arrival of the LCR on the learned advocate for the appellant at once. All other directions with regard to filing of paper book and other incidental directions are suitably extended by the period mentioned in this order, in default, put up for final order. The appeal shall be listed in the monthly combined list of July, 2023.
