Ld. advocate for the petitioner submits that the present case being English Bazar Women P.S. Case No. 259 of 2016 is pending for the last seven years and till date, there is hardly any progress in the case.

It has been brought to the notice of the court that prosecution has relied upon eight witnesses in the chargesheet but, till date, the examination of the first witness is progressing before the ld. CJM, Malda.

Having regard to the time period which has elapsed and the manner in which the case is proceedings or progressing before the ld. Magistrate, I direct that the ld. Magistrate, henceforth, would fix on and from 18.3.2024

one date in a month so that the trial of the case can be concluded within a reasonable period of time. In case, any witness is reluctant to appear, in that case, the ld. Magistrate would communicate with the inspector in charge or the officer in charge of English Bazar P.S. who would submit a report regarding the availability of the witness concerned.

Ld. public prosecutor conducting the case would produce the materials, documents and exhibits on the next date for examination of the witnesses. All efforts be taken so that the trial of the case can be concluded at the earliest. With the aforesaid observations, CRR 4726 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
