Learned advocate appearing for the petitioner is aggrieved by the non-consideration of the communication made to the Officer-in-Charge, Keshpur Police Station.

Report has been submitted by the state.

Report reflects that the petitioners and the others are 'Bhag Chasi'.

Several plot numbers have been referred to in the report.

It is also reflected that the petitioners have cultivated a part of the land as 'Bhag Chasi' for long

and later they bought some of the portions after paying price of portions of land.

Learned advocate for the private respondent nos. 8 to 12 disputes the contentions of the learned advocate appearing for the petitioner that they were never 'Bargadars' or 'Bhag Chasis' and the private respondents are covered by a judgment and decree passed by the civil court.

Be that as it may since the representation has been preferred before the Officer-in-Charge, Keshpur Police Station and it is an admitted position in the report regarding the petitioners having cultivated, a portion of the land, it should be ensured by the Officer-in-Charge that none of the parties are deprived from their dues so far as the cultivation of crops and their usufructs are concerned.

To that extent, the representation made by the petitioner be disposed of by the Officer-in-Charge with the result being communicated to them within a period of 15 days from the date of communication of this order.

With the aforesaid observations WPA 28912 of 2024 is disposed of.

Learned advocate for the petitioner, state and the respondent will communicate this order to the

Officer-in-Charge, Keshpur Police Station within 48 hours.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
